Walla Walla man pleads guilty to sex with teen

Frank J. Avbel agreed to a plea deal that includes jail time and sex offender treatment.


WALLA WALLA -- A man pleaded guilty Monday afternoon in Superior Court to having multiple sexual encounters with an underage girl.

Frank J. Avbel, 24, of 306 Craig St., entered guilty pleas to three counts of third-degree rape of a child for having sexual intercourse with the 14-year-old girl on three occasions in September.

Avbel faces a standard-range prison term of 46-60 months when he's sentenced later. But in a plea agreement, the prosecution is not opposing an alternative sentence that would incarcerate Avbel for up to a year in the County Jail and require him to undergo outpatient sex offender treatment when he's released.

An evaluation has determined that Avbel appears to be amenable to such treatment, but Judge Donald W. Schacht isn't bound by that opinion or any recommendation when he imposes the sentence.

Avbel's brother, Allan F. Avbel, also was arrested and is awaiting trial on a charge of third-degree rape of a child for allegedly having sexual intercourse with a different 14-year-old girl. He faces an additional charge of furnishing liquor to minors.

Police said they began their investigation in the early morning hours of Oct. 24 after receiving a report from the mother of one of the girls. The girl had been attending a party at the Avbels' home when Allan Avbel, 22, allegedly had sex with her in his upstairs bedroom.

Several teenage girls reportedly had been participating in drinking games at the residence that morning, with alcohol supplied by the Avbels. The residence was known to authorities as a "party house" and had been the location of multiple complaints, according to a police report filed in court.

During the course of the investigation, police learned that Frank Avbel had sex with his victim about 30 times in recent weeks, a police report says. Most of the encounters occurred at the Avbels' home.

The Avbels' parents own the residence, but reportedly are gone often.

Police said they had responded to the house at least 16 times since 2009 for calls consisting of assaults, burglaries, domestic problems, liquor violations and other disturbances.

The Avbels were taken into custody Nov. 11, but bail for each was posted later. In interviews before their arrests, they admitted sexual activity with the girls, according to police reports.
