Assault conviction nets man eight-month jail term


WALLA WALLA — A man who assaulted his ex-girlfriend in March was sentenced Monday afternoon to eight months in the County Jail.

Marcial Tiscareno Jr., 25, was ordered to serve the midpoint of the four- to 12-month standard range he faced after pleading guilty last month to third-degree assault.

Superior Court Judge Scott Wolfram went along with a prosecution recommendation on sentencing. The defense asked for the lower end of the range.

As required by law, Wolfram gave Tiscareno credit for the 70 days he’d already served.

Wolfram also ordered Tiscareno to spend a year on community custody, a form of probation. Tiscareno also was assessed $1,737 in various court costs and fees, plus restitution to be determined.

He also will not be allowed to contact Nicole O’Neel, the victim and mother of his child, for five years.

Police said Tiscareno went to the O’Neel’s apartment in the 1500 block of West Rose Street on March 13. An argument ensued, and he grabbed her purse and took out money.

In a struggle Tiscareno kicked O’Neel in her right thigh, according to a police report filed in court.

Tiscareno left with about $450, but O’Neel phoned dispatch and pursued him while carrying her infant child.

“When he realized the police were en-route, he threw the money back in her face,” the police report says.

They then reportedly struggled over the money a second time, with O’Neel trying to fend him off by kicking at him before he ran away.

Tiscareno, of 608 N.E. Fifth Ave., Milton-Freewater, was arrested by Walla Walla police March 25 during a traffic stop.
