The old "the deer ran into the side of my car" excuse, doesn't really work here. The driver should have "passed with care"

Look i understand the driver might have been upset that the cyclist passed him at a stop sign. We are used to seeing traffic violations frequently, but do we have to yell obscenities out our windows?
I did not witness the collision, however the driver of the SUV should have given the cyclist enough "safe space" while passing the smaller vehicle (cycle). Instead maybe the driver decided to get close enough for the cyclist to hear what he had to say.
I looked this up and seems to fit here: (#2 specifically) Since the bicycle was ahead of the SUV therefore the SUV should have passed the smaller vehicle on the LEFT.
Overtaking on the left.
The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions and special rules hereinafter stated:
(1) The driver of a vehicle overtaking other traffic proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken traffic.
(2) The driver of a vehicle approaching a pedestrian or bicycle that is on the roadway or on the right-hand shoulder or bicycle lane of the roadway shall pass to the left at a safe distance to clearly avoid coming into contact with the pedestrian or bicyclist, and shall not again drive to the right side of the roadway until safely clear of the overtaken pedestrian or bicyclist.
(3) Except when overtaking and passing on the right is permitted, overtaken traffic shall give way to the right in favor of an overtaking vehicle on audible signal and shall not increase speed until completely passed by the overtaking vehicle.
Actually, I drove by and witnessed the spectacle myself. Had I just read the article, I may have made the same presumption.
I am hispanic, If I were to yell obscenities at a cyclist then hit her with my car (accidentally) - I think the prosecutor would charge me with "assault with a deadly weapon" or "vehicular assault" -
Then they would give me a poor excuse of a defense attorney like Gail Seimers. I would have to take the plea bargain...
four way stop would suck at 3rd n tietan. Street light's would be better so you don't slow traffic to a complete stop.
